    MY DOG® - METCASH STORES PURCHASE - MAGAZINE SUBSCRIPTION OFFER
    CONDITIONS

    PARTICIPATION

  1. This offer ("Offer") is made by Mars Australia Pty Ltd, ABN 48 008 454 313, of 1 Petcare Place, Wodonga VIC 3690 ("Promoter").
  2. The Offer is available only to "Eligible Claimants". An "Eligible Claimant" is an individual who: (i) is a resident of Australia; (ii) is not an employee of the Promoter or any of its related corporations or any of their agencies associated with the Offer; and (iii) is not a spouse, defacto spouse, parent, child or sibling (whether full, half, step or by adoption) of such an employee.
  3. QUALIFYING PRODUCTS

  4. In the Offer, each 100g pack of MY DOG dog food (any variety) that is sold as a single unit is a Qualifying Product. A package containing multiple 100g MY DOG dog food packs packed together for sale as one unit (a "Multipack") is NOT a Qualifying Product and neither are the 100g packs inside that Multipack.
  5. PURCHASE PERIOD

  6. The Purchase Period is the period between 28/10/15 and 25/11/15 inclusive. The Purchase Period times and dates are times and dates in the place where the purchase is made.
  7. QUALIFYING PURCHASE

  8. A Qualifying Purchase is the purchase, during the Purchase Period, from ) from a store trading under the Metcash banner (including Foodland in SA) that is promoting a Competition in-store, of seven or more Qualifying Products in one transaction.
  9. CLAIM PERIOD

  10. The Claim Period opens 28/10/15 and closes 25/11/15. The Claim Period times and dates are times and dates in Melbourne.
  11. CLAIMING MAGAZINE SUBSCRIPTION

  12. Subject to these conditions, an Eligible Claimant who makes one, or more, Qualifying Purchase during the Purchase Period will be entitled to submit ONE claim, in accordance with these conditions, for a "Magazine Subscription" (a "Claim").
  13. Limit of one Claim per household.
  14. An Eligible Claimant who wishes to submit a Claim must, during the Claim Period, use a compatible browser to visit mydog.com.au/ourstory (the "Offer Website") and follow the directions there to:
    • (i) provide all the details required at the Offer Website, including:
      • (a) the Eligible Claimant's first and last names, telephone number, home street address, postal address and e-mail address; and
      • (b) the last six digits of the barcode number of at least seven Qualifying Products in their Qualifying Purchase;
    • (ii) indicate which Magazine Subscription they would like to receive; and
    • (iii) upload a scanned image or photograph of the purchase receipt that was issued when the Eligible Claimant made their Qualifying Purchase. The image must be no larger than 2MB and in one of the following formats: jpg, png, gif or pdf.
  15. The Promoter takes no responsibility for, and will not compensate any claimant for, any late or misdirected Claim.
  16. MAGAZINE SUBSCRIPTION

  17. An Eligible Claimant whose Claim is accepted will be awarded a 3 month subscription to one of the following magazines (each a "Magazine Subscription"):
    • (i) Australian Women's Weekly
    • (ii) Australian House & Garden
    • (iii) Cosmopolitan
    • (iv) Australian Gourmet Traveller
    • (v) Wheels
    • (vi) Good Health
  18. The following conditions apply to each awarded Magazine Subscription:
    • (i) The delivery of the first issue of the selected Magazine may take up to 6-8 weeks from 24/11/15.
    • (ii) The Magazines will be posted to the postal address provided in the claimant's Claim;
    • (iii) Free gifts and "tip-ons" that may be available with retail copies of Magazines are not provided with subscriber copies;
    • (iv) This offer for the participating titles in this promotion is not valid in conjunction with any other subscription offer/promotion for this title.
    • (v) If a successful claimant is already a subscriber to their chosen Magazine, their subscription will be extended by three months;
    • (vi) Subscribers will be sent a letter of notification prior to the three month subscription period ending.
    • (vii) If a Magazine ceases publication, the subscription will automatically be transferred to a title of similar interest.
  19. VERIFICATION OF QUALIFYING PURCHASE

  20. The Qualifying Purchase used to submit a Claim may be subject to verification by the Promoter. At his/her own cost:
    • (i) a claimant MUST, within 7 days of being asked, deliver to the Promoter (by a means determined by the Promoter) the original purchase receipt that was issued when the claimant made their Qualifying Purchase. The Promoter may elect not to return the receipt.
    • (ii) a claimant MUST also deliver to the Promoter (by a means determined by the Promoter) copies of any other documents the Promoter may request establishing the claimant's eligibility to participate, including evidence of age, residence or identity. The Promoter may make one or more requests for such documents. Once the identity of documents available is established, a claimant must deliver requested copies within 7 days of being asked to do so. At the Promoter's request, a claimant MUST also, within 7 days of being asked, allow the Promoter to inspect and copy the original of any such document.
  21. The Promoter may, at its absolute discretion, declare any or all Claims made by a claimant to be invalid if the claimant: (i) fails to establish their entitlement to participate in the Offer to the Promoter's reasonable satisfaction; or (ii) fails to produce items as required by condition 15 or produces items that, in the Promoter's reasonable opinion, are illegible, stolen, forged, reconstructed, altered, incomplete or tampered with in any way; or (iii) in the Promoter's reasonable opinion, tampers with the claim process or benefits from such tampering; or (iv) in the Promoter's reasonable opinion, makes a purchase which is not in accordance with these conditions.
  22. GENERAL

  23. If the Offer is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, infection by computer virus, unauthorised intervention or fraud, which corrupts or affect the administration security, fairness, integrity or proper conduct of the Offer, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (i) to disqualify any person who the Promoter suspects has tampered with the Offer process; and/or (ii) to modify, suspend, terminate or cancel the Offer, as appropriate.
  24. By submitting a Claim, a claimant is deemed to have accepted these conditions.
  25. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
  26. If there is a dispute as to the identity of a claimant, the Promoter reserves the right, in its sole discretion, to determine the identity of the claimant.
  27. Promoter assumes no responsibility for: (i) any error, omission, interruption, or delay in the operation or transmission of any communication sent to (or by) the Promoter or any claimant whether caused by problems with communication networks or lines, computer systems, software or internet service providers, congestion on any carrier network or otherwise, (ii) any theft, destruction or unauthorized access to, or alteration of such communications; (iii) any problem with, or technical malfunction of, any computer system or other equipment used for the conduct of the Competition.
  28. CAUTION: ANY ATTEMPT TO CAUSE DAMAGE TO ANY WEBSITE OR THE INFORMATION ON ANY WEBSITE ASSOCIATED WITH THIS OFFER, OR TO OTHERWISE UNDERMINE THE FAIR AND LEGITIMATE OPERATION OF THIS OFFER MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. THE PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW IN THE EVENT THAT ANY SUCH AN ATTEMPT IS MADE, WHETHER OR NOT THAT ATTEMPT RESULTS IN ANY SUCH DAMAGE, INTERFERENCE OR UNDERMINING.
  29. All of the Promoter's decisions are final and no correspondence will be entered into.
  30. To the full extent permitted by law, the Promoter, its associated companies and agencies and all those entities' personnel (the "Relevant Parties") exclude all liability for any loss (including any damage, claim, injury, cost or expense) which is suffered or incurred by any claimant in connection with the Offer, including: (i) any indirect, economic or consequential loss; (ii) any loss arising from the negligence of a Relevant Party; (iii) any liability for personal injury or death. Nothing in these conditions is intended to exclude, restrict or modify a claimant's rights under the Competition and Consumer Act 2010.
  31. If any provision of these conditions is unenforceable for any reason, it will be severed and the remaining provisions will remain in full force and effect.
  32. PRIVACY

  33. The Promoter (Mars, we, us or our) collects your personal information when you submit a Claim.
  34. We collect this personal information for the purposes of your Claim, and to send you marketing communications about our brands, products and/or services. We may also use the personal information you give us for consumer care and research purposes, and for other purposes, as described in our privacy policy.
  35. If we do not collect the personal information you have provided in your Claim, you may not be able to submit a valid Claim and may not be able to receive communications about our brands, products and services which may be of interest to you.
  36. We may disclose your personal information to our family of companies and to our vendors or service providers. We require these companies to comply with the Australian privacy laws that apply to your personal information.
  37. Our privacy policy at http://www.mars.com/global/policies/privacy/pp-australia-en.aspx contains information about:
    • how you may access the personal information that is held by us and seek correction of such information; and
    • how you may complain about a breach of the Australian Privacy Principles, or a registered privacy code that binds us, and how we will deal with such a complaint.
